Terms and Conditions of Use and Sale of the DELIPACK Platform
1. Definitions
Advertiser: the User who publishes a Listing to have an Item transported. Listing: the transport request published on the Platform. Item: the object or parcel to be transported. Carrier: the User, individual or professional, who offers to carry out the Transport. Booking: the acceptance of a Carrier's offer, confirmed by payment. Transport: moving the Item from the pickup address to the delivery address. Platform: the delipack.fr website and the DELIPACK apps. User: any person with an Account.
2. Purpose – Role of DELIPACK
These T&Cs define the conditions of access and use of the Platform, specify the rights and obligations of Users, and govern the relationship between DELIPACK and Users. DELIPACK acts as a platform operator and is not a party to the transport contract.
3. Registration – KYC / KYB – Acceptance
Anyone wishing to use the Platform creates an Account via the Website or the App and confirms their email address. The User declares that they are of legal age and legally capable. Before receiving a delivery, the Carrier has their identity verified, opens a payment account with Stripe and accepts the carrier charter. They may provide their professional insurance certificate, which is then checked by DELIPACK and shown on their profile. DELIPACK may request any additional document if in doubt.
4. Access, Security and Account Management
The User is responsible for the confidentiality of their credentials. They must immediately inform DELIPACK in case of suspected fraudulent use.
5. Platform Operation
The Advertiser guarantees the accuracy of the information about the Goods. Users can communicate via messaging. Online payment confirms the Booking. Specific cancellation rules apply.
6. Payments – Financial Flow Management
Payments are handled by the payment provider Stripe. DELIPACK never physically handles Users' funds. DELIPACK deducts from the Carrier’s share an operating commission equal to the secure payment fees (about 2.5% + €0.25 per delivery), taken when the payment is made. The price paid by the Advertiser is not increased.
7. Quality Charter & User Obligations
Users commit to respecting a quality charter (punctuality, courtesy, goods safety, legal compliance for professionals).
8. Prohibited Goods
The transport of narcotics, weapons, live animals, high-value objects, etc., is strictly prohibited (see Appendix 1).
9. DELIPACK Liability
DELIPACK acts as a technical intermediary and is not responsible for damage to Goods during Transport or for Users' failures.
10. Insurance
DELIPACK may offer optional insurance through a partner insurer.
11. Personal Data and Cookies
Data processing is governed by our Privacy Policy.
12. Tax and Social Obligations
Each User is solely responsible for their declarative and tax obligations related to income from their activity on the Platform.
13. Duration – Suspension – Termination
DELIPACK reserves the right to suspend or terminate an account in the event of a serious breach of these T&Cs.
14. Intellectual Property
All Platform content is the exclusive property of DELIPACK.
15. Dispute Resolution
French law applies. Disputes fall under the jurisdiction of the competent French courts.
16. Right of withdrawal
The matching service is free for the Advertiser: the price paid is for the Transport. When the Carrier is a professional and the Advertiser a consumer, the right of withdrawal does not apply to the Transport, as it is a goods transport service provided on a specific date (article L221-28, 12° of the French Consumer Code); the Advertiser may nevertheless cancel the Booking under the cancellation conditions shown on the Platform. The restaurant courier subscription (€4.99 per month, no commitment) can be cancelled without reason within 14 days of subscribing by writing to contact@delipack.fr; if the service started before the end of this period at the courier's request, only the part already used remains due.
17. Specific terms for restaurant owners
A restaurant owner is a User who requests meal deliveries for their establishment, directly on the Platform or through a partner (Commande Restaurant). Registration is free; it requires an active SIRET number and a Kbis extract less than 3 months old or an INSEE registration notice, checked by DELIPACK. The restaurant owner is solely responsible for the meal (quality, hygiene, allergens, compliance with the order), its packaging (closed, suitable for transport and temperature), preparation on time, the accuracy of the customer's address and phone number, and informing the customer of the hand-over rules in article 18. They do not hand over alcoholic drinks for delivery. They pay each delivery at the price they set (a price is recommended), plus a €1 DELIPACK fee including payment costs: the amount is held on their card and charged on delivery. Also due: €3 if the delivery is cancelled while a courier is on the way, or if the order is not ready 10 minutes after the courier arrives; the full delivery price if the delivery fails for a reason not attributable to the courier (customer absent, wrong address, refusal); half the delivery price for returning the meal to the restaurant, if they ask for it.
18. Meal delivery: hand-over and proof
The courier hands over the order at the foot of the building or at the gate, against the delivery code given to the customer; they never enter a building or a home. They carry the meal with care, in a clean insulated bag, never open the packaging, and follow the highway code; they are responsible for their delays and conduct. If the customer is absent, the courier must be within 100 metres of the address, wait 10 minutes, call the customer twice from the app and take a photo on site: these time-stamped and geolocated items prove the visit. A courier who reports absent customers too often is placed in quarantine while their deliveries are reviewed. The restaurant owner may file a claim within 2 hours of delivery; if the courier is at fault, the delivery is refunded. The meal is not refunded by DELIPACK, except as a case-by-case gesture.
APPENDIX 1 – Goods Prohibited from Transport via DELIPACK
Narcotics and psychotropic substances, counterfeit products, live animals, very high-value objects, major cultural assets, weapons, ammunition, explosives, tobacco, cigarettes, radioactive, corrosive, flammable products, organs, human remains, obscene or illegal objects.
