Terms and Conditions of Use and Sale of the DELIPACK Platform
1. Definitions
The terms 'Listing', 'Advertiser', 'Application', 'Goods', 'DELIPACK', 'Merchant', 'Account', 'Co-carrier', 'Partner', 'Individual', 'Platform', 'Booking', 'Trip', 'Transport', 'Carrier', 'User' and 'Site' have the meaning assigned to them in the full T&C document.
2. Purpose – Role of DELIPACK
These T&Cs define the conditions of access and use of the Platform, specify the rights and obligations of Users, and govern the relationship between DELIPACK and Users. DELIPACK acts as a platform operator and is not a party to the transport contract.
3. Registration – KYC / KYB – Acceptance
Any person wishing to use the Platform creates an Account via the Site or the Application. The User declares to be of legal age and legally capable. Full access to features is subject to providing documents (company registration, transport license, insurance certificates, etc.).
4. Access, Security and Account Management
The User is responsible for the confidentiality of their credentials. They must immediately inform DELIPACK in case of suspected fraudulent use.
5. Platform Operation
The Advertiser guarantees the accuracy of the information about the Goods. Users can communicate via messaging. Online payment confirms the Booking. Specific cancellation rules apply.
6. Payments – Financial Flow Management
Payments are managed by third-party providers (Stripe / Mangopay). DELIPACK never physically handles Users' funds.
7. Quality Charter & User Obligations
Users commit to respecting a quality charter (punctuality, courtesy, goods safety, legal compliance for professionals).
8. Prohibited Goods
The transport of narcotics, weapons, live animals, high-value objects, etc., is strictly prohibited (see Appendix 1).
9. DELIPACK Liability
DELIPACK acts as a technical intermediary and is not responsible for damage to Goods during Transport or for Users' failures.
10. Insurance
DELIPACK may offer optional insurance through a partner insurer.
11. Personal Data and Cookies
Data processing is governed by our Privacy Policy.
12. Tax and Social Obligations
Each User is solely responsible for their declarative and tax obligations related to income from their activity on the Platform.
13. Duration – Suspension – Termination
DELIPACK reserves the right to suspend or terminate an account in the event of a serious breach of these T&Cs.
14. Intellectual Property
All Platform content is the exclusive property of DELIPACK.
15. Dispute Resolution
French law applies. Disputes fall under the jurisdiction of the competent French courts.
APPENDIX 1 – Goods Prohibited from Transport via DELIPACK
Narcotics and psychotropic substances, counterfeit products, live animals, very high-value objects, major cultural assets, weapons, ammunition, explosives, tobacco, cigarettes, radioactive, corrosive, flammable products, organs, human remains, obscene or illegal objects.
